Terms & Conditions

Please read these terms of service (the “Agreement”) carefully before using the services offered by Rideinside LLC DBA Iron & Co Issaquah (the “Company”). By visiting the Company’s Website or using its services, you agree that you have read and agree to the terms and conditions of this agreement to the exclusion of all other terms. If you do not unconditionally agree to all the terms and conditions of this Agreement, you are prohibited from using the Company’s website or services. If the terms of this Agreement are deemed an offer, acceptance is expressly limited to these terms.

Scope & Modifications of this Agreement

This Agreement constitutes legally binding terms and applies to such use of the Services regardless of the type of computer, tablet, smartphone or other device used to access them unless such services post a different terms of use, terms of service or agreement, in which case that agreement (“Other Terms”) shall instead govern. By accessing and/or using any of the Services, You agree to be bound by this Agreement (or if applicable, the Other Terms). You are authorized to use the Services (regardless of whether Your access or use is intended) only if You agree to abide by all applicable laws, rules and regulations (“Applicable Law”) and the terms of this Agreement. In some instances, both this Agreement and separate guidelines, policies, rules, or terms of use or sale setting forth additional or different terms and/or conditions will apply to Your use of the Services or to a service or product offered via the Services (in each such instance, and collectively, “Additional Terms”). To the extent there is a conflict between this Agreement and any Additional Terms, the Additional Terms will control unless the Additional Terms expressly state otherwise. Please also review the terms of the Privacy Policy (as provided in the Privacy Policy section of our website).

Rideinside LLC DBA Iron & Co Issaquah reserves the right to change this Agreement and any of the Other Terms or Additional Terms (including, but not limited to the Privacy Policy), at any time, and such changes shall be effective immediately upon posting to the Website. The most current version of the Terms will supersede all previous versions. Iron & Co Issaquah encourages you to periodically review the Terms to stay informed. You acknowledge and agree that Iron & Co Issaquah may notify You of such changes by posting them to the Website and/or the Online Services or by email. If You do not agree to such amended Agreement, then You must immediately close Your Account.

Your Account

In order to access some features of the app, you will have to create an Iron & Co Issaquah account. You may never use another person’s account. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify the Company immediately of any breach of security or unauthorized use of your account. Iron & Co Issaquah is not responsible for any breach of your account resulting from your failure to keep your account password secure, and/or for your failure to notify the Company immediately for any breach of security or unauthorized use of your account.

Purchases

In order to make a reservation, you must first have a session credit or membership. To buy session credits or a membership, you can do so through this web site by logging into your account (if you do not have an account, you can create a new one). Please note that the prices of future classes and memberships might be subject to change. You can reserve classes up to 28 days in advance for most credit types. Certain users and credit types might receive the ability to book classes more than 28 days in advance. You cannot transfer session credits or memberships to another customer or community member. All memberships are non-transferrable and not able to be shared.

Your credit or debit card will be charged at the time you submit your purchase. Memberships are billed on a recurring basis every 28 days from the prior billing date. Once payment is approved, your class credits or membership will be added to your account. If any payment is declined or cannot be processed when due, Iron & Co Issaquah may suspend or terminate your access until payment is resolved. You are responsible for all fees, including attorneys’ fees and collection costs, that Iron & Co Issaquah may incur in its efforts to recover any past due or unpaid balances.

Refunds

All sales are final. No refunds for cash or credit will be provided after purchase.

Cancellations

If you choose to cancel a class after it’s been booked, you must do so 12 hours in advance of the class start time. You can cancel a class reservation by logging into your account and managing your reservation from inside of your account.

If you cancel within the 12 hour window you forfeit the class credit and may incur a late cancellation fee of $25 or a no-show fee of $35, which will be charged to the member’s credit card on file. The fee cannot be paid for with a class credit unless a credit was used to make the reservation. The cancellation window applies to credit packs, membership packages, semi-private training sessions, introductory offers, and unlimited memberships.

Membership contracts are reoccurring and are automatically charged on a month-to-month basis. All new membership contracts purchased have a minimum 3 month commitment. All membership cancellations require 14 days notice via email to hello@ironandcoissaquah.com before the date of renewal. To end your membership, please email hello@ironandcoissaquah.com to verify your cancellation. All members are responsible for making sure their reservation has been checked in and can complete this by checking in upon arrival to the studio inside of their account on our app.

Challenge Deposits

Deposits collected for 6- or 8-Week Challenges are non-refundable. Upon successful challenge completion, the deposit may be converted into an account credit available only toward the purchase of an annual membership (paid in full) or applied as a monthly reduction of regularly priced monthly membership dues. This credit expires 30 days after the challenge end date if unused, holds no cash value, and may not be transferred.

Form of Payment

All payments (including per class payments and incidentals) are payable by electronic funds transfer from your credit card account or debit card account. You must authorize payments to be made through a third party administered electronic funds transfer system. You maintain full control and privacy over your account at all times, and the transfer of funds affects only those fees that have been given prior authorization and when additional transactions are authorized, including but not limited to single classes, class series, memberships, and retail transactions either on Iron & Co Issaquah’s website or in the Studio’s facilities, as well as charges associated with late cancellation and/or no-shows.

Mobile Services

The Site may include certain services that may be available via your mobile phone, including but not limited to (i) the ability to book and/or purchase services via your mobile phone, (ii) the ability to browse the Site from your mobile phone (the “Mobile Services”). Your carrier's normal messaging, data and other rates and fees will apply.

Termination 

We may terminate your access to the Iron & Co Issaquah website and the related services or any portion thereof at any time, without notice. This may result in the forfeiture and destruction of all information associated with you. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in King County, Washington in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Iron & Co Issaquah as a result of this agreement or use of the Site. Iron & Co Issaquah’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Iron & Co Issaquah’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Iron & Co Issaquah with respect to such use.

Collection of Information

We collect personally identifiable information, like names, postal addresses, email addresses, credit card information etc., when voluntarily submitted by our members and/or visitors. The information you provide is used to fulfill your specific request, to improve the experience on our web site, and to ensure a successful experience at Iron & Co Issaquah. Iron & Co Issaquah may also log non-personally-identifiable information including IP address, profile information, aggregate User data, and browser type, from Users of the site. This data is used to manage the Website, track usage and improve the Website services. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to Users. User IP addresses are recorded for security and monitoring purposes. We may also record information about your usage, such as when you use the Iron & Co Issaquah website. If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. “Web Beacons”) in HTML-based emails sent to our Users to track which emails are opened by recipients. We may also use a User’s email address to send updates, a newsletter or news regarding Iron & Co Issaquah. Users may choose not to receive email of these types by following opt-out instructions contained in such email. Iron & Co Issaquah reserves the right to send you important notices about your account even if you opt out of all voluntary email notifications.

Liability Waiver

By attending classes, events, activities, and other programs and using Iron & Co Issaquah equipment, studio facilities, website, or equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of the Iron & Co Issaquah fitness program. You acknowledge that you have voluntarily chosen to participate in a program of intense physical exercise. You acknowledge that Iron & Co Issaquah strongly recommends that you consult with your physician prior to commencing any class. You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You acknowledge that Iron & Co Issaquah uses independent contractors to independently maintain and repair its studio facilities and equipment. You further acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, fractures, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by instructors and staff. In consideration of being allowed to participate in and access the Iron & Co Issaquah classes, equipment and studio facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Iron & Co Issaquah equipment, classes and studio facilities, (2) release, indemnify, and hold harmless Iron & Co Issaquah, subsidiary affiliate entities, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Iron & Co Issaquah classes, equipment or Iron & Co Issaquah studio facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of Iron & Co Issaquah’s classes and studio facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in Iron & Co Issaquah classes, equipment and use of studio facilities, and should not be participating in any classes.

Loss of Property

You are encouraged not to bring valuables into the Studio premises and to keep valuables with you at all times. Iron & Co Issaquah shall not be liable for the disappearance, loss or theft of, or damage to, personal property (including money, negotiable securities and jewelry). You agree that Iron & Co Issaquah is not responsible in any way for the safekeeping of your personal belongings.

Use of the site by Minors

If you are under 18, you may register and use the Iron & Co Issaquah Website and App only with the involvement of a parent or guardian. Iron & Co Issaquah does not accept the online registration of minors; please do not attempt to register on the Website or App if you are under the age of 18. Registration of a minor can only be completed in person at the Iron & Co Issaquah studio with a parent or guardian. Minors who are at least 16 years of age, meet the minimum height requirement of 4'11", who have submitted a Minor New Rider Waiver Form signed by a parent or guardian, may sign up for Iron & Co Issaquah classes online.

Provisions

Special Events. The Studio may from time to time reserve the use of its facilities for special events, competitions and private functions.
Dress Code. Proper athletic attire is required. The Studio reserves the right to make the final determination in its sole discretion with regard to appropriate attire.
Change in Operating Hours/Temporary Closing of Studio. As a result of repair, maintenance, special occasions, or act of nature, the Studio may be required to restrict the use or temporarily close its facilities or activities from time to time. Hours of operation may be amended from time to time, and certain facilities, services or programs may be added or eliminated from time to time, at the Studio’s discretion.
Orientation & Preparation. Iron & Co Issaquah strongly encourages you to arrive early as well as request ongoing support available at the Studio to ensure the proper and safe use of all equipment.
